NearbAI Terms and Conditions

Welcome to NearbAI, an AI-based event finder mobile application provided by Mospan Sp. z o.o., a company based in Poland (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the NearbAI app and related services (“Services”). By downloading or using NearbAI, you agree to be bound by these Terms. If you do not agree, please do not use the app.

Description of the Service

NearbAI is an AI-powered platform that suggests events based on user-provided filters such as location, topic, and date. We utilize advanced AI models (e.g., Google’s Gemini or similar technologies) to analyze your inputs and provide event recommendations. While we strive for accuracy, event information is obtained from third-party sources or AI predictions. We are not the organizers of these events, and we do not guarantee that the information is accurate, complete, or up-to-date. Always verify details with the official event organizer or source. AI-generated suggestions may occasionally be incorrect or misleading; please use your own judgment.

Optional proactive suggestions: In addition to on-demand searches, we may offer an optional feature that proactively suggests nearby events if you enable it in the app’s privacy settings. This feature requires a separate, express opt-in and can be turned off at any time. Details are in our Privacy Policy.

Eligibility and User Guidelines

By using NearbAI, you represent that you are at least the age of digital consent in your country (13+ in many countries) and will use the app in compliance with these Terms and applicable laws. You must not: (a) use the Services for unlawful, harmful, or fraudulent purposes; (b) attempt to hack, reverse engineer, or compromise the app; (c) scrape or harvest data; (d) use automated systems that overload our infrastructure; or (e) post illegal, infringing, or offensive content. We may suspend or terminate access for violations.

Accounts and User Identification

NearbAI does not require a traditional account. We assign a unique user identifier (UUID) when you first use the app. The UUID is stored on your device and backed up via Android Auto Backup or iOS Keychain so it persists across reinstalls, enabling restoration of your token balance and settings. You’re responsible for securing your device. Each installation/UUID is treated as a separate user unless we provide a sync mechanism.

Tokens, Purchases, and Pricing

• Free tokens. New users receive a limited number of free tokens to try core features. The app shows how tokens are consumed (e.g., one token per AI search).
• Purchasing tokens. When free tokens are exhausted, you can buy token bundles via in-app purchase. Transactions are processed by Apple/Google (including Apple Pay/Google Pay when available) and Stripe via their respective in-app systems. We do not receive or store full payment card data.
• Prices and taxes. Prices (including applicable taxes/fees) are shown in your local currency and may change from time to time.
• Delivery, refunds, and withdrawal. Tokens are digital content delivered immediately upon purchase. All sales are final and non-refundable, except where mandatory law provides otherwise (e.g., certain EU consumer rights). By purchasing, you consent to immediate delivery and acknowledge that any statutory withdrawal right may be lost once delivery begins and the tokens are available to you.
• Token rules. Tokens have no cash value, are non-transferable, and do not expire during normal operation. We may revoke tokens or suspend access in case of fraud or abuse.

Ads and Rewards

We may show advertisements (including optional rewarded ads that grant a free token) while you wait for AI results. Ad experiences are subject to our Privacy Policy and any applicable consent.

Role and Third-Party Services

We are not the creator, organizer, or owner of events listed in NearbAI, nor do we sell tickets. Links to ticketing sites, maps, or other third-party services are for convenience. We are not responsible for third-party services, terms, or content. Any transaction you enter into is between you and that third party.

Intellectual Property

The NearbAI app, software, logos, and compiled event data are owned by Mospan Sp. z o.o. or licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use NearbAI for personal, non-commercial purposes.

Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law. We do not warrant that recommendations or event information will be correct or suitable, or that Services will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential damages, or loss of profits, data, or goodwill. For token purchases, our aggregate liability will not exceed the amount you paid for the tokens in dispute. Nothing limits liability that cannot legally be excluded.

Indemnification and Release

You agree to defend, indemnify, and hold us harmless from claims arising from your misuse of the Services or violation of these Terms. You release us from disputes between you and third parties regarding events, content, or transactions.

Privacy

Your use of the Services is subject to our Privacy Policy.

Service Changes

We may modify, suspend, or discontinue the Services (in whole or part). Continued use after changes indicates acceptance.

Governing Law; Venue; Consumer Rights

Polish law applies (consumer mandatory protections may apply in your country of residence).
